Here’s the truth: defending someone who didn’t do it means proving something didn’t happen. That’s no small task. We don’t just punch holes in the State’s story—we reconstruct the entire timeline. We show what actually happened during the alleged incident. We put witnesses in the room. We account for everyone who was there.
I did this recently in a case involving an apartment over a weekend. The allegation had a tight timeframe. So we subpoenaed everyone who was present from Friday morning to Sunday. And one by one, they testified. They described exactly what they saw, where they were, who was in which room. When we were done, the story the child told couldn’t possibly have happened. There were too many people around. Too many eyes. Too much truth in the way.
Sometimes these cases involve mistaken identity. With today’s forensic tools—especially DNA—it’s not as common as it used to be, but it still happens. If I think the wrong person’s being targeted, we treat that with the same level of intensity.
